All, Mr. Johnson has become preoccupied with other duties, and as such I will be rendering the verdict in this case. After reviewing the case and all evidence provided by the parties, I have made the following opinion: A Law Enforcement Officer, who acts in good faith and has reason to believe that a crime has been committed is justified in enforcing the penal code on violations that they observe themselves. In the matter of a traffic collision, when both parties present do not wish to press charges and no other offense has been committed and observed the the LEO, there is no reason for a charge to be pressed. When all parties involved with the collision are able to resolve the matter civilly, there is no justifiable reason for an LEO to intervene in the matter. That being said, a LEO who observes that the vehicles have collided and believes that a violation has been committed has a right and a responsibility to identify the individuals present by a state issued ID, regardless of whether or not the violation is charged to the individual.  Based on Officer O'Conner's narrative and the charges he pressed, it does not appear that Officer O'Connor observed any offense aside from the collision that was resolved by the involved parties. Officer O'Connor did not act within the scope of his law enforcement duties when he attempted to identify the parties on scene, and as such Mr. Savage DJ is not guilty of the charges. Mr. DJ did plead guilty to F33 Unlawful Possession of a Firearm/ Firearm Magazines, but based on Officer O'Connor's lack of probable cause, the F33 will also be dropped. Mr. DJ will have the charges removed and be reimbursed for both the fine and time spent incarcerated. As there is currently no standard set for monetary reimbursement for time served, I have decided that he will receive $2,500 per month incarcerated.
